MOTORISTS MISHAP ■ JUGDMENT AGAINST BOROUGH COUNCIL (Per Press Association.) OAM ABU, Ala reh 9. Judgment was given by Mr Bundle, S.M., this morning, against the Oamaiu Borough Council, on a claim by James B. Clarke for £3O 18s damages for a collision by a motor car with a tree «n Thames Street on the night of February 18, 1926. The tree was near the corner where a line of centre trees ends and the side trees begin. The light on the corner was out on that night. Plaintiff ran into the tree, which had no white guard around it. The Magistrate said that where the Council allowed a tree to obstruct the highways, it should take precautions against danger, and it was Ihe Council’s duty to see that the light was kept alight.
