The High Court, by a majority, decided that the Commonwealth Arbitration Court had the power to make a building award, ordering the Steamship Owners’ Association and its members to pay members of the Federated Seamen’s Unions of Australasia engaged in inter-State trade at a shorter period than one month. The Chief Justice and Mr Justice Duff dissented on the ground that such shorter payment was inconsistent with the expressed terms of the seamen’s agreement.
