WANGANUI BOROUGH COUNCIL. jVOTICE is hereby given that at a Special Meeting of The Wanganui Borough Council duly convened and held at the Council Chambers St. Hill Street 1 ooT 2 '? 11 ’! 1 ou . the 27th da y of July, 1921 the following Resolution (intended to operate as a Special Order) was duly passed : WHEREAS by Deed of Lease bearing date the 11th day of June 1921 and made between The Mayor Councillors and Burgesses of the Bcrough of Wanganui (hereinafter called “the Borthe first part WILLIAM HENRY CLAPHAM of Wanganui and JOHN MASON \VKLLS of the same place Accountant of th o second part AND SAMUEL IRWIN of Wanganui Draper (hereinafter called “the Lessee”) of the third part the land comprised and described in the said Deed of Lease being all that parcel of land situate in the Town of Wanganui containing 26.66 perches more or less being part of Sections Numbers 5/ and 58 on the plan of a subdivision of Blocks Numbers 31 and 32 and part of Block Number 24 of the Wanganui A ow - I k ße,t deposited in the District Registry Office at Wellington as Number 219 BOUNDED towards the northeast by other part of Sections 57 and 58, 2(XI links; towards the south-east by Section Number 56, 83.3 links; towards the South-west by Queen’s Avenue 200 links ; and towards the Northwest by the Town Beit Road, otherwise known as Carlton Avenue 83.3 links WAS demised and leased by the Borough and demised leased and confirmed by the said William Henry Clap ham and John Mason Wells to the Lessee for the term of twenty-three years and six months from and inclusive of the first day of December 1920 at the yearly rental of Two pounds three shillings and fpurpence (£2 3s 4d) until the first day of June 1923 and at the yearly rental of Two pounds fourteen shillings and twopence (£2 14s 2d) for the balance of the said term AND WHEREAS the Lessee has requested the Borough to accept a surrender of the said lease of the said lands and to grant a new lease of the said lands to the Lessee in the manner for the term and upon the covenants conditions and provisions hereinafter appearing which the Borough with the consent of the said William Henry Clapham and John Mason Wells have agreed to do NOW THEREFORE the Wanganui Borough Council in pursuance and exercise of the powers vested in it by The Municipal Corporations Act 1920 and all other powers enabling it in this behalf DOTH HEREBY RESOLVE by way of Special Order: 1. —To accept a surrender of the said Deed of Lease of the 11th day of June 1921 and to grant to the Lessee a new lease of the said lands comprised in th© said lease. 2. —The terms of the said new leasj? to be twenty-two (22) years and nine(9) months from the first day of September 1921. 3. —The rental to be paid in respect of the said lands to be the sum of Ten pounds (£10) per annum land such rental to be paid half-yearly on the first day of the months of March and September in each year of the said term. 4. —The said new lease to contain : (a). A covenant for the granting of renewals of the said lease in perpetuity at an annual rental to be fixed by valuation of the full and improved ground rental of the said premises that ought to be payable du\r.in.g such term without taking into consideration the value of any buildings or improvements then existing upon the said lands for successive periods of iourteen (14) years. I (b). The same covenants mutatis mutandis as are contained in leases of the Town Belt of the Borough of Wanganui now granted by the Wanganui Borough Council and such other covenants conditions and provisions as are contained in the said present lease to be surrendered as aforesaid or are authorised by the said Act and agreed to by the parties to the Lease. 5. —The form of the said new lease and the covenants and provisions thereof to be settled by the Borough Solicitor. 6. —Th© Lessee to pay all costs and charges incurred in the preparation and advertising of this Special Order and shall also pay all costs and charges in connection with the preparation and execution of th© said new lease. AND that the above Resolution will be submitted for confirmation at a Meeting of the Council to be held on Wednesday the 24th day of August 1921 at 7’30 o’clock p.m. at the said Council Chambers.
