NEW PLYMOUTH, Dec. 9

At the Supreme Court the Chief Jus-J tice sentenced prisoners as follows :— Mary McLean (native), fonr months' hard labour for bigamy; Jack Johnston, iour years' reformative treatment on each of eight charges of breaking and entering and theft (sentences concurrent) ; Neville Jaems Crazier, common assault. two years' reformative treatment; Francis Douglas Still, breaking and entering and theft, two years' probation: Percy Lewis Ward, forgery and uttering, three years' reformative treatment; Wm. Arthur Woods, theft, two years' hard labour. In civil business* Rudolph G. Laurent ♦ Eltliam) sued Edward McGinty (New Plymouth) for £903 damages for breach of agreement; in recard to the lease of the racing mares Staccato and Haversack. Breach of agreement was alleged in defendant returning Haversack, j which he alleged" was lame and unfit for racing. Staccato had an accident on the Hawera course in May last and died. Plaintiff received Haversack bar* under protest, but refused to release McGinty from the agreement.

Far the defence a nonsuit was moved on the grounds that the implied condition in the agreement was that both horses should remain suitable for the purpose for wtych tfye lease was given rtnd as cne was not fit the agreement was void; also that both must continue to live for the term of the lease, and as one had not, the defendant was therefore free! from the agreement. The defence also alleged that Haversack was unfit at the time and prior to the lease

Evidence had concluded when the Court adjourned.
