SEQUEL TO MINER'S DEATH.

At the Police Court, David MeNeill was charged with failing to withdraw Robert William Smith from an unsafe place in the Brighton coal mine. Mr MacGreg6r, K,C, who prosecuted, said the defendant was manager of the mine, and Smith was killed by a fall of stuff. The defendant at 7.55 a.m. on the day of the accident examined the fall where Smith was working, and found it safe. At 2 p.m. he again visited the place, and heard a sound which indicated looseness. The defendant told deceased to take down the stuff. On his return at 3.5 p.m. he found this had not been done, and told him emphatically to take it down. The fall took place almost immediately afterwards, and Smith was killed.
Defendant's counsel argued that the instructions given were reasonable.
The magistrate said the defendant should Lave withdrawn Smith. Defendant was fined £5 and costs.
