NOTICE IS HEREBY GIVEN thai at a Special Meeting of Th< Wanganui Borougn Council duly convened and held at the Council Chambers St. Hill Street Wanganui on the 14th day of October 1919 th« following Resolution (intended tc operate as a Special Order) was duly passed: — WHEREAS by Deed of Lease bearing date the seventh day ojc Octobei 1902 and made between the Mayoi Councillors and Burgesses of the Borough of Wanganui . (hereinaftei called "the Borough") on the one part and WILLIAM KENTISH Me LEAN therein described o_ the other part registered in the Deeds Registry Office at Wellington : s Number 84970 the land comprised and described in. the-said Deed o£ . Lease being ALL .that piece or parcel of land-situate in. the Town of WanganuT and containing two (2) roods more or less being the Sections Numbers 21 and 22 on a plan of a subdivision of Blocks Numbers 31 and 32 and part of Block Number 24 Wanganui Town Belt deposited in the Deeds Registry Office at Wellington as Number 249 ' was demised and leased by the Borough to the said William Kentish McLean his executors administrators and assigns for the term of 42 years from and inclusive of the, first day of June 1902 at the yearly rental during the first twenty-one (21) years of the said term of Seven pounds and during the remaining twentyone years thereof of Eight pounds fifteen shillings AND WHEREAS the lands and premises comprised in the said Deed of Lease Number 84970 are now vested in ALAN BLAIR of Wanganui Brewer for the remainder of the said term WHEREAS the said Alan Blair (hereinafter called "the Lessee") has requested the Borough to accept a Surrender of the said lease of the said lands and to grant a new lease thereof to the Lessee in the manner for the term and, upon the covenants conditions "and provisions hereinafter appearing NOW THEREFORE the Wanganui' Borough Council in pursuance and exercise of the powers vested in it by The Municipal Corporations Act 190.8 and all other powers enabling it in this behalf DOTH HEREBY RESOLVE by way of Special Order:— 1. To accept a Surrender of the said Deed of Lease of the seventh day of October 1902 and to grant to the Lessee a new lease of the said lands comprised in the said lease. 2. The term of the said new lease to be twenty-one years from the first day of December 1919. 3. The rental to be paid in respect of the said lands during such term to be the sum of Fifteen pounds (£ls) per annum and such rental to be paid half-yearly on the first day of June and the first day of December in each year of. the said term. 4. The said new lease to contain: (a.) A covenant for the granting of renewals of the said lease in perpetuity at an annual rental to be fixed by valuation of the full and improved ground rental of the said premises that ought to be payable luring each such term without talcing, into consideration the value of my buildings or improvements then existing upon the said lands for successive periods of twenty-one (21) fears. (b.) The same covenants mutatis mutandis as are contained in leases 3f the Town Belt of the Borough of Wanganui now granted by The Wan?anui Borough Council _nd such :ther covenants conditions and provisions as are contained in the said present lease to be surrendered as iforesaid or are authorised by the said Act and agreed to by the parses to the lease. 5. The form of the said new lease md the covei ants and provisions ;herein to be settled by the Borough Solicitor. 6. The Lessee to pay all costs and jharges incurred in the preparation md advertising of this Special Order md also to pay all costs and charges n connection with the preparation md execution of the said new lease. AND that the above Resolution will be submitted for confirmation at i Special Meeting of the Council to >c held on Tuesday the 11th day of Slovember 1919 at 7.30 o'clock ).m. at the said Council Chambers.
