AN IMPORTANT JUDGMENT.
(Per Press Association.) WELLINGTON, May 20
A judgment of importance in No-Li-cense districts was delivered by Mr.. Hutcheson, S.M., to-day. Victor Coleitihii, landlord of the Club Hotel, was charged with keeping such premises as a place of resort for the consumption of intoxicating liquor. The- facts were undisputed. Ono of the rooms was fitted up as a. temperance bar, which is the resort of many who bring with them alcoholic liquor, which they consume tb-ero.
Mis Worship said that if Section 37 could be roa-d as making or permitting a place to be iised us a resort for tin; consumption of intoxicants, the defendant must have been convicted; but tho soclion couW not be so construed. Itis the purpose for which the defendant keeps tho bar. and not the purpose which other people, may have in comiiHg there, which .is the essential point. The Magistrate concluded: "it is not only not suggested that the defendant keeps the bar for tho purpose of the consumption of intoxicants, but siivb view is expressly repudiated by tho prosecution. The case is dismissed."
