AN UNUSUAL CASE.
(Per Press Association.} AUCKLAND, Nov. 6. A form of civil procedure not very frequently employed was the subject of a. motion before Mr Justice Cooper when Mr H. P. Richmond- (instructed by Messrs Bell, Gully, Bell and Myers) applied on behalf of Thomas E. Edison, Ltd., of Sydney, phonograph dealers, for liberty to issue a, writ of attachment against James Maekie, of Auckland, phonograph record dealer. An injunction was obtained by the plaintiif company last August restraining Maclrie 'from selling Amber© records (Patent number 25,418) >at prices less than the prices prescribed for the saiv. in the Edison catalogue. The price of these records had been fixed at 2s 6d, and defendant, prior ,to the injunction, sold them >at 2s each. After the service of % the writ -of injunction, he, according to tho affidavit filed, continued, through his servant or assistant, to sell the records at 2s each.. The defendant did not appear to defend the motion, and it was stated by Mr Richmond that since the service of the proceedings upon him, he had left his premises. His Honour made the order applied for, empowering tho plaintiff company to have defendant arrested upon a writ by the Sheriff, and brought before tho Court.
