McCullough, employers' and workers' representatives respectively. In the case in which tho Inspector of Awards sought to recover from tho Wellington Gas Coy. a penalty for an alleged breach or. tho carpenter's award by employing a carpenter at Miramar outside the two mile radius from tho city without paying for tho timo occupied in travelling to and fro, tho Court held that tho company was not carrying on a building business within tho meaning of tho award. Tho company was engaged in tho manufacture- and sale of gas at Miramar and any building work it did was incidental to its main business. , Judgment was given for the defend- ' ant. Air. McCullough did nut concur in the judgment, considering that the company carried on the business in Wellington. !
