WELLINGTON, October 14. The Appeal Court gave judgment today in tiie case of the Commissioner of Taxes v. Nightcaps Coal Company, heard at the last sittings. The company claimed that the annual value of business premises, to the extent of £785, .should be deducted in assessing the income tax. The company claimed all its improvements as busines.9 premises, tat the Magistrate, who hoard the objection, excluded the railway, dwelling house, and fencing. The appeal from the Magistrate's decision, was allowed with casts.
