REID v. N.Z.L. AND M.A. COMPANY-

WELLINGTON, September 19. A second action, traversing the same events in connection with the Aramoho Freezing Works as those which have been before the Supreme Court for the last eleven days, was commenced this morning. This is the case of William Reid, for whom Mr Chapman appears., v. the New Zealand Loan and Mercantile Agency Company, represented by Mr Bell. The plaintiff -was creditor for £16,000 and a guarantor for £8000 (both loan and guarantee secured1 of Thomas Mitchell, who was the plaintiff in the case of Mitchell v. X.Z.L. and M.A. Company, Ernest Johnson (manager of Mitchell's Works), and John Stevenson (defendant company's Wanganui manager). In the Mitchell case fraud and conspiracy was alleged against all the defendants iii that (briefly) they, though the agents of and fiduciary to Mitchell, destroyed the confidence between Mitchell and his guarantor Reid, concealed Mitchell's financial prospects from Reid, induced Reid to assign his securities at a, secret profit of £8000 to the defendant company, concealed Reid's action from Mitchell, and induced Mitchell to assign his estate to the defendant Johnson as trustee, and indirectly to the defendant company which entered into possession of the works and other property. - The plaintiff Reid in the present .case seeks the restoration of his securities on the repayment of £8000, on the' ground that they were bought at an undervalue through the. fraud and concealment of the defendant company. The evidence of the plaintiff, who is advanced in age, was taken this morning, in order that he might not be brought again to Wellington. Witness narrated the circumstances leading up to the appointment of Ernest Johnson as manager of Mitchell's Works before Mitchell left for Home in August. 1900. His evidence was generally similar to that, adduced during the hearing of the previous case, the circumstances of each having a direct bearing on one another.
