NAPIER.
A ssault. —The Resident Magistrate, Mr. Curling, has been brought before the Bench for assaulting Mr. Wilson, a solicitor. AiUr the evidence had been fully gone into, tho Bench took a few minutes to consider their judgment, during-which time the court was cleared.- Mr. Cooper, as chairman, expressed tho pain with which the Bench had heard the case, and their regret that a person holding the position of Resident Magistrate- should so far have forgotten that position as to commit a breach of the peace. At the -same time they were convinced that much provocation had been given ; and the court-was certainty surprised that a solicitor should have felt himself at liberty to repeat such a conversation as that which seemed to have taken place between himself and the Resident Magistrate, and should have permitted himself to use such an expression as that any case coming before that court had been prejudged. 7’ho court found the defendant guilty of an assault, but, looking to the provocation given, would fine him ono shilling and costs.
