Those two brutal ruffians, James Road, the Captain of the American vessel Fetid, and Cuarles Henry Foley, his chief mate, recently charged,at Auckland wrth the wilful murder of the cooper of that vessel, have escaped all punishment lor their crime. That these two ruffians did maltreat and assault the unfortunate man, and that he died, there is no doubt at all. But then it was not proved that the maltreatment of the man caused his death, and as a primu facie case ot killing requited to be made out against the accused before the Extradition Act could be applied to them, the .Magistrate had to discharge them. It therefore follows that brutal captains and mates of American vessels can beat and bruise a man within an inch of his life, and, so long as they don’t kill him outright, they will escape punishment when brought before a Court in a British possession. Verily, law is law. Foley, the mate, was delighted at his acquittal, and exclaimed, “ Freejagaiu ! Hallelujah 1 Glory to God 1 ’’ as he matched out of the police station. Yet the bupteruo Power thus impiously invoked hy this unspeakable ruffian will mete him out adequate justice when he comes before that tribunal.
