Husbands and Wives.

Some remarkable developments have taken place lately as to the legal positions of husbands and wives. Mrs Messenger, the wife of the publican at Christchurch, who was lately brought back from Australia on a charge of wife desertion, recently left that city for Auckland, leaving her six children to the care of the father. The husband has retaliated by laying an information a gainst bis wife for stealing his furniture, &0., to the value of £35. Mr Beetham did not issue a warrant, but summoned Mrs Messenger to appear in Christchurch. The case was called on recently, but Mrs Messenger did not appear, so a warrant will probably be issued against her. Then a man named Fargon, living at Christchurch, had been away from his wife. The latter had a protection order and the house and furniture belonged to her. The husband returned and entered the bouse to see his wife. The wife ordered him out and he refused to go, so she pulled him up for trespass. The Resident Magistrate iu giving judgment in the case said “ The wife has no right to refuse the society of her husband, even to the extent of cohabitation, unless by sanction of the Supreme Court, given after solemn procedure. My opinion is that a husband can enter a house which is the separate property of his wife to enjoy her society, that is, if he can enter without destroying property. The charge of trespass against the husband was dismissed.
