PRISONERS GUILTY
AN ESCAPE PROM CUSTODY. fßv Telegraph. Press Association.) - AUCKLAND, this day. On charges of breaking and entering and theft and of escaping from lawful custody, Augustine William Sullivan, aged 35 (Mr Noble), was tried in the Supreme Court yesterday, before Mr Justice Herdman.
Mr Meredith, Crown Prosecutor, said that early in January of this year the house of Thomas Marshall Johnstone, Victoria Avenue, Remuera, was broken into and jewellery, clothing, a service revolver and other articles, valued in all at £97 10s, were stolen. Shortly after the robbery accused appeared in Rotorua with a man named Edwards. The two stopped at a boarding house and there were a number of suitcases in their possession. • Constable R. Ambrose, of Wellington, 1 described how accused escaped from his custody by jumping off a train on May 6. Detective Moore [ stated that accused was again taken into custody on May 8. | Constable Forsyth told of arresting Sullivan near Pirongia, and that he admitted having jumped off the train soon after leaving Frankton. , Sullivan at first said he was pushed off the train, and when that contention was rebutted he claimed that he was not on the train, remaining at Frankton, from where he made his way to Pirongia. He added that all the property in the suitcases belonged to Edwards. He had not accompanied Edwards to any houses in Auckland and he did not know where all I the contents came froVn. Accused was found guilty of receivI ing stolen property and of escaping from custody. ‘He was remanded for sentence.
