JURY'S AWARD UPSET.

THE PICTURE THEATRE CASE. CHRISTCHURCH, Wednesday. The verdict of the jury awarding Robert Eagle £375 damages for injuries sustained by falling into a cellar in the Grand Picture Theatre was upset by Judge Sim to-day. The judge said the defendant's duty to protect plaintiff did not extend to the whole theatre, but only parts to wihich plaintiff might reasonably be expected to go in the belief that he was entitled or invited to go. Plaintiff ought to have realised when he opened the door and found the room in darkness that he had no right to enter. Instead, he elected to go into the darkness, and was not entitled to complain of any concealed danger. He walked in at his own peril. There was no evidence of negligence on the part of defendant company, and judgment would be entered for the defendant.
