I NAPIER HARBOUR BOARD. ill the matter of a Bill intituled 11 The Napier Harbour Board Empowering and Vesting Act, 1916.” Notice is hereby given that it is the intention of the Napier Harbour Board (hereinafter called “the Board”) during the forthcoming session of the General Assembly of New Zealand to promote the passing of a Bill to enable the Board: (1) To borrow subject to the provisions of “The Harbours Act 1908” and of the proposed Act the sum of £50,000 for the purposes of the payment of the moneys and the construction of the works required to be paid and constructed by the Board in terms of the agreement No. 1 set out in the Schedule to the “Port Ahuriri Westshore Road and Railway Act 1914” as modified by Section 38 of the “Reserves and other lands disposal and Public Bodies Empowering Act 1915”; the demolition- and removal of the bridge referred to in paragraph 10 of the said agreement and the construction or doings of such other works and things as in the opinion of the Board shall be necessary as a conseqence of the execution of the works referred to in the said agreement; the reclamation of such areas in the Inner Harbour of Napier as the Board shall think expedient; the purchase of all machinery and plant necessary to carry out all or any of the aforesaid works; the erection of Cargo sheds at the Inner Harbour of Napier. The sum proposed to be borrowed may be borrowed without a Poll of the Ratepayers but shall be deemed to be portion of the sum of £300,000 author- < ised to be raised on a Poll of ' the Ratepayers by the “Napier Harbour Board Empowering and Loan Act 1914” (herein- - after called “the 1914 Act”) so that not more than £300,000 in all can be raised under the • 1914 Act and the proposed Act. The Debentures to be issued by the Board as security for the loan j will be a first charge on the Harbour Funds subject to all existing charges thereon. The Board is to provide for repayment of the loan by setting ajmrt as a Sinking Fund a sum equal to Ten Shillings pef centum per annum on the aggre- • gate amount of debentures for the time being issued, the same to be paid to the Board’s Sink-

ing Fund Commissioners. Any Receiver on behalf of the Debenture Holders who may be appointed under The Harbours Act shall, by virtue of his office, have power to make and levy a special rate on all rateable property in the Harbour Rating District in such proportions as that the rate in the Borough of Napier shall be double the rate in the remainder of the District. Such special rate shall not exceed such amount as is required to provide for interest sinking fund and expenses of making levying and recovering the same and the remuneration of the Receiver. (2) To have vested in it for an estate in fee simple under the provisions of The Land Transfer Act 1915 the old course of the Tutaekuri River from the point where the new course intersects the old course opposite the Easternmost boundary of Meeanee Suburban Section Number 4 to the mouth of such River in the Inner Harbour of Napier. (3) To lease and sell to The Napier High School Board for the purposes of a High School a parcel of land containing Twentyeight acres Thirty-three perches more or less part of Te Whare-o-maraenui Reserve situated on the Western side of a continuation of Hastings Street South, Town of Napier, and commencing about One thousand four hundred and twenty links south of Ellison Street. Upon the terms and condtions of an Agreement in writing' entered ihto between the Board and the Napier High School Board a copy of which is set out in the Third Schedule to the said proposed Act. (4) To sell to the Education Board of the Education District of Hawke’s Bay by private treaty the Sections Numbered 509, 600, 601, 603, 604, 609, 610 and 611 on the plan of the Township of Napier South upon which the Public School now stands.
