COURT OF PETTY SESSIONS.
Waipawa, October 31. (Before- Messrs J. Lawrence (chairman), H. H. Bridge, and R. Harding.) Newton and Johnson v. Bestic, claim £4 8s for goods supplied. Judgment for plaintiffs for amount claimed and costs. J. J. Tye v. Honguez, claim £3 13s. The case was struck out, there being no appearance of the parties. Rithbone v. Hougnez, claim £3 Is. Settled out of Court. Brighouse v. Hougnez, claim £5. The defendant had forwarded an affidavit to the effect that he was in possession of a receipt given by plaintiff for all moneys due to him. As the receipt had not been forwarded with the affidevit, the Bench refused to accept the latter as a clearance of the debt. Mr Brighouse stated that he had given the defendant a receipt in June last, but it was on a transaction different from that before the Court. Judgment was accordingly entered for the plaintiff. Jeffrays v. Gibbs, claim £5. The case was struck out, the parties to the suit not aj pearing. Kbhctt v. Brighouse, claim £ls 10s. This was a case of disputed account, the defendant stating all the goods charged for had not been delivered. In one instance also there was an overcharge of £2 on a load of hay. The plaintiff testified that he himself lmd delivered the goods to defendant’s servant, und pro duccd his books in evidence. As for the overcharge on the buy, he had only charged Mr Brighouse the price which had been paid by others. Evidence was taken as to the quality and amount of goods delivered, ami after a good deal of conflicting testimony, the Bench gave judgment for plaintiff, with 19s costs. Leach v. Barrigun, claim, £ll 17s 6d. {Settled out of Court. In a case brought hv the same defendant against Downey for £3 10s, the service of the summons hail not been proved, and the case consequently did not proceed. Leach v. Oldii.g, claim, £l7 3s lid. Judgment for amount and 29s costs. Hartshorn v. Bellshaw, claim, £ll 13s. Case dismissed ; no appearance of the parties. Brighouse v. Blackburn, claim, £9. The case was dismissed, Mr Brighouse not being present when the suit was called on. Siftflc v. Phillips, claim, £6 12s o*l. No appearance. Ca-*e dismissed.
