i A TEST CASE
At the S.M. Court, Palmerston North on Monday last, R. H. Biliens, editor and publisher of the Manawatu Daily Times, was sued under eight headings, for publishing what it was declared by the police were “tips” for the Feihting races. The police declared that notes published were offences against the statute, inasmuch they gave advice as to the probable result of the races. The prosecutors pointed out that of sixteen horses mentioned in the notes in question, there were twelve starters, two being placed first, three seconds, two thirds, and live unplaced. For the defence, counsel argued that this kind of notes wore published by nearly all the newspapers in New Zealand. He contended that to forecast the results meant placing the horses in their order.
