PUBLIC NOTICE IS HEREBY GIVEN that a Special Meeting of the Masterton Borough Council will be held at the Council Chambers Chapel Street Masterton on Friday the 23rd day of April 1909 at 7.30 p.m. to consider the confirmation of the following special order and r< solution: — The Masterton Borough Council hereby resolve to make aud do make the following special order: — ! "WHEREAS Edward William Peters of Masterton farmer (as transferee from Edward Peters) is the holder of a lease from this Council of all that parcel of land situate in the County of Masterton containing 120 acres more or less being run 27 Block 111. Tiffin Survey District such run being held by this Council as a waterworks reserve AND WHEREAS the said Edward William Peters desires to surrender his said lease and take a new lease as hereinafter appears to which the Council agree anc; consider that the rights privileges and easements granted by such new lease will not interfere with the proper use of the reserve NOW THEREFORE this Council by this special order DO HEREBY agree to surrender of the said lease AND TO GRANT to the said William Edward Peters his executors administretora and assigns a new lease of the said reserve for a term of 14 years as from the 12th day of. November 1907 at a I rental of £25 pur annum payable J half-yearly in advance (such rent being declared to be a rack rent) and such lease to contain the same terms and conditions as.the former lease with these additions: That the lease shall contain expressly or by express implication the provisions in favour of a lessae contained in clause (ii) of sub-section (b) of' paragraph (1) of section 136 of The' Municipal Corporations Act 1908 AND also a reservation in favour of the Council reserving all the rights of tne Council to use the waterworks reserve where reasonably necessary and in a reasonable manner for waterworks purposes as if the lease were not granted AND by this special order THIS COUNCIL DECLARES and resolves that the rights easements and privileges proposed to he granted to the lessee under and by such new lease will not interfere with the proper use of such reserve."
