ACCUSED COMMITTED FOR TRIAL. By Telegraph—Press Association. \ OAMARU, October 30. T? The hearing of the case against Fiodlay, in connection with the murder of Rennie, at Papaksio, was, continued in the Magistrate's Court, to-day. The evidence goes to piove that Findlay is identical with the ssilor supposed to have escaped from the Port Stephens. Rebecca Tomlinson, residing on the Stewart Settlement, said accused had been shopping with her off and on since September Ist. On September 20th, accused left and said he was going to' Oamaru on a bicyole. He returned again on the 26tb. He left again and returned to witness' place on October 4tb. Wit ness having heard of the death of Rennie told the accused that, the polioe would be round to see him, as he was on the road at the time, and aocused replied: "All right, I'm here to see them," Accused was not in the habit of staying out late at night, and the night of October 3rd was the only occasion upon which be stayed out late. John Henry Beardsmore, grocer's carter, said he had known 5 accused for about three or four weeks before the murder. He had seen him at Mr Tomlinson's on Tuesday, October 2nd. Witness saw him at the schoolmaster's at Awamoko about 10.30 in the morning near a creek by the master's residence. Aocused asked witness for some oigarette tobacco, but witness had none. Acoused asked witness to tell Tomlinson he would be home that night. He said he had come down the road with a runaway sailor, whom be left at the Awamoko Factory Road, and that the sailor had gone down to see somebody who was working in a padand was going to Beardsmore's store to laok fsr work., Acoußed did not say tfhere he slept the night before. Accused told witness he was going about oaavassiag for ; a bakery and that he was going to apply for u section upon which to locate it. Witness went to TomlinI son's that afternoon, ancl delivered Findlay's message, and the articles Ihe ordered at the store. Witness did not see acoused again until Thursday, October 4tb, in one of Tomliuson's paddocks. On October 9th witness again saw acoused near Tomlinson's. They discussed the murder and the latter said he oould not see how a man could have been shot in bed from the door the way he was lying. Accused said he thought the murder had not been committed with a .303 rifle, but with a revolver. Findlay was fioomiitted to stand his trial at the Supreme Court, at Dunedin, on November 19th.
