MASTERION—MONDAY.

(Before Mt W. P. James, S.M.).

William F. D. Sutherland was charged with having at Wellington, on January 22nd, 1906, deserted from H. M.S. Prometheus. Accused was committed to the Wellington prisou to be detained according to law - Robert Wallace pleaded not guilty to a charge of having boon found on licensed premises, to wit the Central Hotel during prohibited hours. Defendant stated ttmt he went to the hotel to deliver a paruel, and did not seek drink. F. S. Ooopnr gave corroborative evidence, The case was dfsmissed. Mr B. J. Dolan appeared for the defendant. Frederick S. Cooper, licensee of the Central Hotel, was charged with haviug on Sunday, October 7th (1) kept open his lieeuped premises for the sale of liquor, (2) allowed liquor to be consumed on his licensed premises, (3) exposed liqtiur for sale in his licensed premises. Mr C. A. Pownall anpeareH for defendant, who pleaded uot guilty. Sc-rgeant Millar stated that he visited the Central Hotel on tbe morning of the 7th inst. Ho found the licensee inside the bar with the slirio open and fiva men were standing in the bar room. There were six glasses on the ledge. Tbo men said they were hoarders at tbo hotel, bii 1 ; witness replied that he did not think they were boardors. Harry Hall, Peter Graham and Harold Fitzgerald, in the course of their evidence, said that they were stopping at the Central Hotel. They went to the bar to got a drink each, but did not have any liquor, as Sergeant Millar appeared. There were sevoral empty glnsses on the ledge, but they must have been there overnight. Sergeant Millar (hen stated~that he had no doubt that the other two men were hoarders. The Magistrate dismissed the three informations, remarking that he did not think on tbe evidence, that the Sergeant had a case. William Palmer, alias Downes, was charged with having been in possession cf liquor on October 6tb during the currency of a prohibition ordor against him. Sergeant Miller and Constable Le Fevre stated that they visited Palmer's house on October ,6th, and found defendant aud his sou sitting at a table on which there whs a bottle of beer aud two mugs. Defendant stated that ho did not know where the beer oame from. A flue of £5 with 7s costs was imposed, in default ouo month's imprisonment. A month was allowed in which tc pay tbo fine.
