Warden's Court
(Before E. W. Burton, Esq., Warden.) The only local, matter before the Warden's Court yesterday was an application bv Hugh M. Quilter {or a water race of ten heads from a point iorty yards from Thomson and Party's penstock £nd terminating at his dam No. 293. Mr Finlayson appeared for the applicant and Mi Moore for the objectors, Charles Thompson, 0. H. Bjorngaard, William J. and Lass Christian, and B. luldseth. 'J'he evidence of Charles Thomson (one of the objectors) was taken when Qfc Finlayson asked to have the application amended to read as an application to have an order of the Warden fixing the price to be charged applicant for water by Thomson and party. Mr Moore objected to such alteration and the Warden upheld the objection on the ground that such alteration would be raising a new question altogether between the parties. Mr Finlayson then asked and was granted permission to withdraw the application, the following costs being allowed objectors Court costs 6s, witnesses expenses, £1 15s ; solicitor's fee„ £3 3s. Hugh Nelson v. J. McGregor and A. Cowie.—Olaim of £3OO balance due on agreement to purchase interest in dredge and mining property at Adams Flat. In this case which was heard some time ago, judgment was finally entered for the plaintiff for £3OO with Court costs ISs; witnesses expenses £3 1 lis Bd, and solicitor's fee £lO 10s. Mr: W. F. Inder, of Gore, appeared lor plaintiff at the original hearing of the suit and 3Slir .r. McGregor of Dunedin for the defendants.
