James Harris. — Application for bottle license. No objection. Granted. Mrs. Clark. — Application for publican's license. Report : Character good, accommodation sufficient. William Houstin. — Application for publican's license. Report : Character good, accommodation sufficient ; but license undesirable, as the house was near the new railway works, and there was a good deal of disorderly conduct rife in the neighborhood — not necessarily caused by this house. ,The applicant had held a license for two ancVa half years, and had not been convicted under the Licensing Ordinance of any offence. Mr. Inspector Thompson repeated that there was nothing objectionable in the applicant personally. Granted. Joseph Gardner. — Application for a publican's license. Mr. M'Coy appeared for the applicant. Report : The accommodation sufficient ; but the conduct of the house was not good. The applicant had been twice fined for offences against the Licensing Ordinance, and in other respects the conduct of the house was not satisfactory. Mr. M'Coy pointed out that the house was near the railway works, which had caused a sudden influx of population of the laboring class, which rendered it very difficult to conduct the business of a house in as orderly a manner a 9 under ordinary circumstances. There were many shanties about, to which much of the disorderly conduct of that neighborhood might be traced, and the stigma occasioned thereby attached wholly to the licensed house. The applicant had "been for some years licensed,

but until the sudden increase of the population, owing to the railway works, there had been no complaint against him. The depriving him of his license would ruin- him. The offences of which he had been convicted were of a most venial character, and would not call for the loss of his license, which, would be as much as he would suffer had they been of the gravest character. Postponed for fourteen days.

Mark Higgins. — Application .a for bottle license. No objection. Granted. — Application for a wholesale license postponed for one month. Mr. M'Coy afterwards applied that the wholesale license might be granted in respect of some new premises. After some conversation, the matter was allowed to stand over.

Mr Gooday objected to any one but a barrister or solicitor being allowed to appear for one who did not appear in person. The Court agreed with Mr. Gooday, but said that, as this was the first sitting under the Act, there might be some mistake. They would not, therefore, pass over the application. Adjourned for 14 days, to allow applicant to appear personally, or by counsel. Sinclair M'Beath. — Application for a publican's license. Mr. Henderson appeared for the applicant. Report : Character good, accommodation sufficient. Granted.

Johanna Lewis. — No appearance in person, or by counsel. Adjourned for 14 days. Henry M'Cay, John Johnson, Roberfc Cotton, Ellen Humphrey, Thomas Reynolds, Joseph Cox, Robert Grieve, and Ellen M'Swiney. — Applicants for licenses neither personally, or by counsel. Their applications were adjourned for 14 days. .-Margaret Dickson. — Application for a publican's license. Mr. Henderson appeared for the applicant. Mr. Henderson pointed out that no time was limited by the Act within which an application for a bottle license should be applied for. The matter stands over for fourteen days. Christian Long. — Application for a publican's license for the Eureka Hotel, Wether--stones. Mr. M'Coy appeared for the applicant*. The application had not been sent in time. Mr. M'Coy argued that the section of the Act stating that the application should be sent in on a certain day was directory morely. The application had been in in sufficient time for the Application to be duly advertised, though that had not been done. In support of the argument that the' Act was directory, he quoted Pearce v. Morris, and Rex v. Justices of Leicestershire. As to the officer not having advertised the application, that was not Long's fault ; it was an act of omission of the officer of the Court, and curia meminem gravabit. Adjourned for fourteen days.
