(Before W. L, Simpson, . E.aq,, 8.M.) Lyons v. Anderson. Claim, L.lO, damages done by detendant's cow to plaintiff's property, Wetherstones road. Mr Copland for plaintiff, Mr M'Coy for defendant. The plaintiff iv this case failed to prove ownership of the cow said to nave done the damage. The case was> decided without calling any evidence for the defence. Plaintiff non-suited with costs, and 1 guinea professional fee. Toe nonsuit was granted to enable the plaintiff to bring on the case again, if he thought it desirable.
