RACE ARGUMENT.
Court Sequel to Dispute Over Dividend. NEW BRIGHTON CASE. An argument over the sharing of some money won on the third race at New Brighton on Saturday had a sequel in the Magistrate’s Court this morning. Thomas Mooney, a labourer, 30 years of age, of Wordsworth Street, appeared before Mr E. D. Mosley, S.M.. and pleaded not guilty to charges of stealing £1 4s 6d from Arthur Dunoraft, assaulting Duncraft, and using insulting language. Moonejr, for whom Mr Twyneham appeared, was convicted and discharged on the first charge, and ordered to refund the money. He was fined 20s and costs on the charge of assault, and for using insulting language was convicted and ordered to come up for sentence within six months if called upon. According to »Senior-Sergeant Fox, accused accosted Duncraft on the course and suggested that they should have a small bet together. They had os each on the second race. Duncraft then bought the ticket on the third race and gave it to accused. Later, when he asked accused for his 5s and his winnings, the horse having run second, Mooney denied ever having seen Duncraft. A disturbance occurred, and accused struck Duncraft on the jaw, and used the language complained of. He was under the influence of liquor, although not drunk. Mooney told the Magistrate that he had never seen Duncraft before, and had been mistaken for someone else. I stopped a punch on the head one night because I was mistaken for someone else.” said Mooney.
