LOST JURY’S AWARD.
Husband Not Able to Sue Himself. (Special to the “ Star.**) MELBOUURNE, November 27. Although a jury in the County Court yesterday awarded Patrick Lcnaghan, an unemployed miner, £5 damages against the Powlett branch of the Australasian Coal and Shale Employees’ Federation for the loss of the society and services of his wife who was injured in an accident, he will not receiv# it. Judge Moule decided to-day that at the time of the accident Lenaghan was himself a member of the Powlett branch of the union, and was not entitled to sue. His Honor entered judgment for Mrs Lenaghan for the £350 awarded her by the jury, with costs to be taxed, against the members of the branch on the day of the accident. He gave judgment for the Federation against Lenaghan without costs. Mrs Agnes Lenaghan, of Dowling Street, Wonthaggi, rug maker and boarding-house keeper, said she broke both legs when she fell in a gutter when leaving the Union Theatre, Wonthaggi, which is owned by the Federation. She alleged that the stair l -' of the theatre were not reasonably safe.
