CLAIM FOR OVERTIME
Non-suit Entered at Timaru. Per Press Association. TIMARU, October 25. “As I cannot accept plaintiff’s evidence as to hours worked, and as the burden of proof in the circumstances rests heavily upon plaintiff, and he has not discharged that burden, he must fail in the general claim,” said Mr C. R. Orr Walker, S.M., in the Magistrate’s Court, in entering a nonsuit against A. E. Way, chef at the Hermitage, in the case in which he claimed £S3 12s over-; time from the Mount Cook Tourist Company. 'The original claim was for £139 15s Gd for 978£ hours’ overtime, but it was subsequently amended.
