BRUTAL ASSAULT.
Five-year Sentence on Young Man. JUDGE’S COMMENT. Per Press Association. PALMERSTON X., October 26. Concurrent sentences making a total of five years’ imprisonment were imposed by Mr Justice Macgregor on Lindsay Edward Edist Garner, twentytwo years of age, of Wellington, who had been found guilty earlier in the week of assaulting, with another person unknown, Christian Sorensen, a storekeeper at Himatangi with intent to rob. The prisoner was also charged with assault so as to cause actual bodily harm, and assault only. After counsel had pleaded that accused should be sent to a Borstal, the judge observed that it was a brutal assault on an old man, eighty-four years of age. Under the Crimes Act accused was liable to imprisonment for life and a whipping on the charge of assault with intent to rob. A sentence of five years was imposed on the major charge, three years on the second count, and one year on the third.
