INTOXICATED DRIVER.

Fine of £ls and Costs Imposed.

On a charge of being intoxicated while in charge of a motor truck, Herbert Rowland Swindells (Mr M. JBurns) was to-day fined £ls and costs by Mr E. D. Mosley, S.M., in the Magistrate’s Court at Kaiapoi.

Constable Holmes stated that defendant was arrested on the evening of September 23. An examining doctor had certified that Swindells was intoxicated. Mr Burns, on behalf of defendant, pleaded guilty under extenuating circumstances. Defendant, he said, was having a hard struggle. The Magistrate said that he would take into account counsel’s strong plea for leniency although he w r as right against being lenient with such offenders. Defendant was fined £ls and costs, in default one month’s imprisonment. lie was ordered to take out a prohibition order.
