SEAMEN’S ACTION UPHELD
Refused to Sail with Vessel’s Boatswain. Per Press Association. WELLINGTON, July 3. Judgment for defendants was given by Mr E. Page, S.M., to-day in a case in which John Brown, a seaman, proceeded against the Federated Seamen’s Union, F. P. Walsh, the president of the union, and twelve members of the crew of the Waihemo, claiming £250 damages in consequence of an alleged conspiracy to deprive him of employment as iDoatswain of the vessel. The Magistrate said it was plain that plaintiff's methods in handling the men created considerable unrest among them, and this was the substantial cause of their refusing to sail with him. “ In my view,” he said, “ these seamen, finding harmonious working under the plaintiff impracticable, had reasonable grounds for refusing to sail with him as boatswain. Their action in so refusing was not wanton or malicious, or done for any ulterior motive, and in my opinion does not give rise to an action against them.” There was no cause, he said, for connecting the union or the president with the case.
