Hitch Over Application for New Award. An application was brought yesterday by the Canterbury Shirt, White : and Silk Workers’ Union to have the ! recently concluded industrial agreei ment made into an award by the Ar- 1 bitration Court. 1 Mr J. H. Roberts, who appeared for 1 j the union, said that a majority of the ; employers employing a majority of j j the workers in the district had signed j the agreement. I His Honor said that those parties : who had signed the agreement were j ; bound by it, but those who had not : : yet signed it were not liable under it, j | since no dispute had ever been created, j ! Until they were joined in the agree- j j ment, no award could be made. 1 Mr D. I. Macdonald, who appeared ! i for the employers, agreed with his j Honor’s statement, but objected to the 1 making of a new award. Until the old one was disposed of, those parties who had not signed the new agreement were ; still bound by it. When the old award had been disposed of, the parties J could then be added to the agreement. ' His Honor Mr Justice Frazer decided , to refuse the application, as there was • a danger, if it was granted, of there ; being two awards side by side in the | same district. A refusal would leave j either side free to get rid of the old j award by creating a dispute. ' Associated with his Honor were j Messrs W. Cecil Prime ( employers’ re- ; j presentative) and A. L.
