John Fanning Johnston, was convicted and lined £1 and costs 10s for being found on licensed premises after hours, at the Lyttelton Magistrate’s Court this morning, when he appeared before Mr H. A. Bisjnan v. Percy Scott. £2. Claim For Possession. Annie Gillard claimed possession of ». dwelling rented front her by Alfred Johnston. It was contended by the plaintiff that she required the dwelling for her mother, who was an invalid. The dwelling was situated next to the house occupied by plaintiff, and It was plaintiff's intention to occupy both houses in order to look after her mother. After hearing further evidence, the Magistrate non-suited plaintiff on the grounds that plaintiff had continued to accept rent after notice to quit bad been given, thus establishing a r- w contract. Defendant was allowed £2 2e solicitor s fees.
