Hunt, S.M.. in the Police Court when Walter M’Cann, aged 32, engi neer, appeared on a charge of usinj the telephone to make a false state ment with the intention, of makinj Cyril Lewis act to his substantial detri ment. James Ileares, motor mechanic, whe was formerly a fellow-emplo3'ee witl M’Cann under Lewis, said that or February 15 M’Cann suggested to wit ness that he should put through a tele phone call to Lewis telling him that c taxi had broken down at Otahuhu, anc requesting him to send a towing-cai and mechanics. Witness did this. Cyril Lewis', garage proprietor, saic that on receiving the telephone mes sage he became suspicious, and. as the result of inquiries, did not send a cai to Otahuhu. A denial that M’Cann had suggested the telephone message to Heares was made by another motor mechanic Edwin Douglas Hart, who stated that Heares had said he was tired of his job and was going to ring Lewis and tell him he would not be back at work. “ I am not prepared in the circumstances to convict M’Cann.” said the Magistrate, in dismissing the case.
