Clark and Co., Ltd., v. J. Ccok and W. Nilsson, costs only. Claim by Plasterer. R. J. Estall, 5, Manning Place, Woolston, plasterer (Mr Cuningham) claimed £lB 14s from E. L. Wyles and Co., 211, Cashel Street, agents (Mr Burns). The statement of claim set out that, plaintiff agreed to purchase 1500 bundles of Oregon laths at 3s lOd a bundle. The defendant company had delivered all except eighty-two bundles, but relused to deliver same to plaintiff in terms of the contract. Plaintiff had been compelled to purchase, others at 4s 6d a bundle. Therefore he claimed £lB 9s damages for breach of contract and 5s cartage. Judgment was given for plaintiff for the full amount with costs. Thomas Waddell and Sons, Ltd., St A=aph Street. Christchurch, engineers (Dr Haslam) clakned £7B 10s from W. 11. Lake, Balmoral, farmer (Mr Cowlishaw), alleged to be the amount due for one set of castings for a patent sold and delivered by plaintiff to the defendant.
Judgment was given for the plaintiff for the full amount with costs.
