DAMAGES FOR BARONET.
Claim Successful at the Second Trial. Per Press Association. WELLINGTON, August 12. The same issues as were framed for the jury’s consideration at the first trial last week were put to a jury to-day in the Supreme Court in the retrial of the action for £347 15s lid special and £2500 general damages between Sir Kenneth Douglas, Bart., of Wellington (plaintiff) and the Victoria Laundry Company, Ltd. (defendant). The action, was brought by Sir Kenneth as the result of severe injuries when he was knocked down by a Victoria Laundry van driven by William Albert Weldon at the junction of Constable and t Riddiford Streets in 1930. On the jury’s answers to the issues, his Honor entered judgment for plaintiff for £347 special and £BSO general damages, with costs according to scale, witnesses’ expenses and disbursements. Mr Leicester raised the question of whether the jury’s answers did not amount to a verdict in favour of defendant, and his Honor reserved leave to the defendant company to move for a nonsuit of judgment. All questions relating to the costs of the first trial were reserved in the meantime. His Honor, said he would take an early opportunity of consulting with Mr Justice Blair, who presided at the first trial, as to his views on the subject.
A line drawn across Yorkshire from Huddersfield to Flamborough Head, marks the northern limit of the distribution of the nightingale in Britain. The nightingale may, of course, on occasions reach beyond this, but the birds recorded as singing further north have proved to be sedge warblers whenever the instance* could be investigated.
