Tompkins), was charged before Mr Wyvern Wilson, S.M., in the Hamilton Magistrate's Court with being intoxicated while in charge of a car. Accused pleaded not guilty. Evidence was given by Constable M’Lean that, as a result of a complaint that accused had collided with a stationary car in Greenwood Street, Frankton, he saw accused and considered that he was intoxicated and was not in a fit condition to drive a car. Accused said he was reducing his weight and had had no food yesterday. He had a brandy and soda in the afternoon, but was not intoxicated. The car he struck was unlighted, and was halfway between two lamp posts. The Magistrate expressed the view that the police had made a mistake in considering that Rennie was intoxicated.
