OBTAINED WORK BY FALSE PRETENCES.
INTERESTING POINT IN CASE AGAINST MAORI. Per Press Association. WANGANUI, July 13. An interesting case was dealt with before the Magistrate, Mr Salmon, when a Maori, Ruby William Matthews, was charged that with intent to defraud he obtained from the Unemployment Board three separate amounts of £1 17s 6d by means of a false pretence by falsely representing that he was married and supporting a wife and two children. The evidence disclosed that defendant had no dependants and was in receipt of a war pension of £3 4s a month. Mr W. J. Treadwell contended that there was no contract between defendant and the Unemployment Board and the money was secured, not as a result of a false pretence, but for work. Work was not capable of being stolen. The Magistrate said that it was clear
the defendant did not obtain the money by false pretences. He obtained only the right to work. The only thing defendant was guilty of was obtaining a contract of service by false representation. ITe dismissed the information and suggested that an amended one might be laid.
