£lO FINE IMPOSED ON INTOXICATED DRIVER. In the Magistrate’s -Court this morning. John Martin, a dairy farmer, pleaded guilty to a charge of being intoxicated in charge of a motor-car. Mr E. D. Mosley, S.M., was on the Bench. Senior-Sergeant O’Hara said that defendant had been driving citv wards along Ferry Road, and turned into St Asaph Street. There he overtook a cyclist, and rah into him. A constable, on investigating, found ' that defendant was intoxicated, and had a flask of whisky in his possession. The case was not an aggravated one. " My client had certainly had a drink too much,” said Mr Lascelles. “1 don’t know whether it was on account of the nor’-westers or not. He has never had any trouble with his car before, and, as the prosecution says, the case is not an aggravated one. He was not helplessly or wildly drunk, just a little under the influence.” “I, will only refrain from cancelling his license if he agrees to take out a prohibition order against himself,” said the Magistrate. The defendant agreed to take out an order. The Magistrate convictec* the defendant, and fined him costs.
