MAN MUST NOT DRIVE CAR FOR THREE YEARS.
WAS CONVICTED AND FINED £ls BY MR E. D. MOSLEY, S.M. Because Kenneth Andrew Bayne was in charge of a motor-truck while intoxicated last evening, he must not drive again for three years and in addition he must pay a fine of £ls or go to gaol for a month. Bayne, a milk-man, admitted the charge to-day. •Senior-sergeant Lewis said that the man and his brother were in a motor truck, accused driving, when they collided with a motor-car at the intersection of Barbadoes and Gloucester Streets. Mr Woodhead, for accused, said that the two brothers had a small milkround and worked from 4 a.m. until 9 p.m. each day. They occasionally had a “break.” “Their ‘break’ yesterday was a bit too big,” said counsel. Mr Woodhead said that accused and his brother were the sole support of their aged parents. “This man received an injury to his shoulder,” he said, “and his brother was cut on the nose as a result of the accident, but not a great deal of damage was dorre to the vehicles.” “It’s a question whether I should send him to gaol,” observed the Magistrate. Accused was convicted and fined £ls in default one month’s imprisonment, his license was cancelled and he will not be able to secure another for three years from April 1 next. Christopher Phillip Bayne, the other brother, then appeared on a charge of drunkenness. He pleaded guilty. “Convicted and fined 20s in default forty-eight hours’ imprisonment,” said the Magistrate. “It is only 20s because I can’t give you more.”
