CLAIM AND COUNTERCLAIM.
Because he had allegedly driven hi» car in a negligent and unskilful manner, thereby being responsible for damage to another car in a collision on the Main South Road near Dunsandel on April 5 last, Herbert L. Bradlord was the defendant in a civil action, when he was proceeded against by Herbert Edward Bonnington for damages to the extent of £34 2s 3d. Defendant counter-claimed for £ll2 7s 4d. Plaintiff’s claim was made up of £2O general damages- and £l4 2s 3d special damages. Defendant’s claim included £72 7s id general damages and £SO m respect of depreciation of his car. Mr North appeared for the plaintiff, and Mr Alpers for the defendant. The Magistrate said thataftcr hearing the evidence for the defence—especially that of the defendant himself —he was quite sure that the accident was due to the defendant. Bradford ought to have decreased his speed. Judgment would be for the plaintiff on the claim for £2B 12s 8d and witnesses’ expenses £ls 10s 4d. A nonsuit was enteied on the counter-claim.
