EX-CHATHAMS FARMER WINS CASE. , AGE OF HOUSE ,I,_ INDUCEMENT. Air Justice Adams to-day heard legal argument in a dispute over the sale of a house in St Albans Street. Ernest Aloses Hail, builder, was plaintiff, and Frank Regjiault, retired farmer, wav defendant. Air Alpers, for defendant, said that there was no suggesting of fraud on the part of the land agent, Ronald S. Badger, or his employee, Alatson, but there had been gross carelessness. Air Sargent, who, with Mr Edgar, appeared for plaintiff, agreed that there was no suggestion of fraud, and his Honor said that that question was not raised. Air Sargent said that Air and Alr.s Regnault wished to be relieved of the purchase of the house. His Honor said that he did not think that plaintiff could succeed. None of the witnesses, evidently, wished to tell anything but the truth, and defenhdant and his wife, his Honor -was convinced, had stated exactly what they believed to be corrects A statement as to the age of the house, no doubt, would be an inducing cause in the purchase. Judgment was given for defendant, with costs as in an action for £3OO His Honor allowed for counsel for second day £5 ss. The deposit of £IOO paid by defendant will be refunded to him.
