ALL SMOKE DID NOT RUN.
OTAHUHU FRAUD. ACCUSED FOUND GUILTY. The hearing of the All Smoke case, which lasted two and a half days, was concluded yesterday. His Honor Mr Justice Adams occupied over an hour in summing up jury brought in a verdict of guilty after a retirement of four hours. Tli© charges against William Williamson. Charles Hopwood Capes aad Alfred Tucker, to which they pleaded not guilty, were : (lj That on November 17. 1923, at Christchurch, they did conspire to defraud tlio Otahuhu Trotting Club. <2) That on November 17, at Christchurch, they did conspire t? commit a crime punishable by three years’ imprisonment with hard labour, to wit, the crime of obtaining money from f he Otahuhu Trotting Club with intent t© defraud by representing a trotting horse unknown to be the trotting horse AH Smoke. (3) That on November 21. at Auckland, with intent to defraud, they did attempt to obtain of and from the Otahuhu Trotting Club the sum of £175, by representing a hors© unknown to be the trotting horse All Smoke. ( 4) That on November 24. at. Auckland, with intent to defraud, they did attempt to obtain of and from the Otahuhu Trotting Club the sun* of £175 by representing a horse unknown to bo the trotting horse All Smoke. The jury retired at 11.50 am , and returned at 4 pm. with a verdict of guilty on the first two counts (conspiracy), against Tucker, Williamson and Capes, and a verdict of guilty on the remaining counts against Williamson and Capes. Sentence was deferred till Wednesday.
