OWNER ANXIOUS TO SELL
MISREPRESENTS TAKINGS OF BUSINESS. Per Press Association. AUCKLAND, December 14. The Supreme Court gave judgment for plaintiff for £650 with costs in an action by Mrs Mary Somervell against Miss Ash, claiming £BOO on the ground of^"misrepresentation in the sale of the business of the Alexander restaurant in Queen Street, for which plaintiff paid £BOO cash and a mortgage for a similar amount for the balance of the purchase money. The misrepresentation' alleged was in respect of the defendant’s takings prior to the sale of the business. Mr Justice Stringer said he acquitted defendant of any conscious and premeditated intention of cheating the plaintiff. He thought the statement on which plaintiff relied Avas made recklessly and without reasonable grounds for believing it true, defendant, in her anxiety tc* sell, being careless of whether it* was true or not. In the eyes of the law that was actionable misrepresentation.
