That, a wife cannot be libelled by her husband was tho decision of a Recorder of the Central Criminal Court, in quashing an indictment against a husband for publishing a defamatory libel against his wife. The defence quoted a. leading case on the subject in which it wa£ held that a wife could not pro oeed against her husband for libel, a libel might arise from angry passions and a desire for revenge, which might lead to a breach of the peace. Tho Recorder commented as follows : “ I suppose the judge thought that passions ought to be settled in the domestic forum. If a man hits his wife she has her remedy. If he inflicts a more severe injury by writing libellous postcards she has none.’'
