A. V. WHITTA’S APPEAL.
FORMAL APPLICATION DISMISSED. There was an echo of the Whitt a ca*es in the Supreme Court to-day. when Air F. D. Sargent, for Mr C. S. Thomas, formally asked that an appeal lodged against the decision of Mr S. E. M’Carthv, S.M.. in a charge against Albert- Vivian Whitt a. .son of William Vivian Wnitta. under the- Gaming Act, fill cold be dismissed. Air A. T. Donnelly, Crown Prosecutor, said that tho application had been standing for seme time, hut aa the penalty of three months’ imprisonment imposed by the- Magistrate li3d been remitted, it was not proposed to go- or with the appeal. He asked that the application should be dismissed and for C °%t Ss ,. gP nt said that lie- would not oppose the grounds on which ccfds were asked for. His Honor Mr Justice Herdman dismissed the application for appeal, and made- an order for £7 7s costs.
