The question whether auctioneers can sell meat was involved in an action taken by the City Council against'an auctioneer for selling moat without a meat vendor’s license issued bv the council under a. by-law which' aims mainly at preventing any departure from sanitary conditions. .Defendant contended that if the by-law was valid it did not apply to him, defendant being an auctioneer and not a meat vendor, because an a-uctioneer’s license had been issued permitting the holder to sell anything in New Zealand. “ The question arises,” said defending counsel, “ can a by-law prevent a man from selling by auction when a license has been given him by statutory right? ” Decision was reserved.
