MAGISTRATE’S NEW RULING. fPer Press Association. 3 WELLINGTON, February 24. ~ new filing. was Kivnn by Mr Page, t>.Al., in the Magistrate s Court, in a tenement case, in which the landlord applied for possession on tho ground that the tenant had fallen into arrears in rent for the past six months. Tho plaintiff held that the Act allowed the Magistrate no option but to make an order, but the defendant stated that tho rent had fallen into arrear on account of his continued illness, and that He had five children, while the plaintiff had only one child. The Magistrate held that he had discretion in such a case, and refused to make an order while the current rent was paid, as well as a, sum paid off the arrears.
