Mr o'Rogaii ; Wellington, has received cabled advice from Melbourne that Mr Justice Gusseu’s reserved judgment has been delivered in favour of plaintiffs in the action of five Auckland waterside workers against t!i« AA'ischer Proprietary, Ltd. The jury recently awarded plaintiffs £6350 damages. This was subject- to a nonsuit point by defendants that they owed no duty to observe care towards anyone except tho firm from whom they received the order, namely, Posen ham and Co. Mr Justice Cussen’s reserved decision gave judgment for the Kill amount, with scale costs, witnesses’ expenses and disbursements. including the cost of taking tho evidence ot twenty-live witnesses at Auckland.
