MR VICTOR BRAUND'S APPLICATION. [Pee Pskss Association.] DUNEDIN, May 9. In giving the decision on Mr Victor 'Braund's personal application, regarding the Colonial Bank's books, Mr Justice Edwards, on behalf of .himself and Mr Justice Cooper, concluded thus: — " Even if we had the jurisdiction, upon the applicant's motion, to disturb the order made by Mr Justice Williams for the destruction, of the books and papers of the bank, the applicant has not, in our opinion, shown sufficient cause for doing co, inasmuch as h© has failed to show us that the production of the books is necessary for the purposes of the action he lias begun, and he has failed to satisfactorily account for the delay in the proceedings. In our opinion, therefore, the order in Chambsra dismissing the applicant's motioir was riojbtly made, both upon tihus ground and upon the ground that the applicant has no status to intervene. We therefore dismiss the motion, with, seven guineas costs." Mr Braund then asked the Court to postpone the destruction of tho books, pending his application to the Court of Appeal. . Mr Just-ice Edwards replied that the Court had no power to make such an order on Mr Braund's application, but suggested that it might be made on the liquidators' application, Mr Eraser, the advisor of the liquidator, said he would consider this, and accept the Court's permission to say to-morrow morning whether or not he would apply.
